RE: The tariff classification of Mefenpyr-diethyl (CAS-135590-91-9) Dear Mr. Pinchok:

In your letter dated December 29, 2005, you requested a tariff classification ruling.

The subject product, Mefenpyr-diethyl [CAS name: diethyl 1-(2,4-dichlorophenyl)-4,5-dihydro-5-methyl-1H-pyrazole-3,5-dicarboxylate], is an herbicide safener (a chemical that protects crops from injury by herbicides, but does not prevent the herbicide from killing weeds). The applicable subheading for Mefenpyr-diethyl will be 2933.19.3700, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Heterocyclic compounds with nitrogen hetero-atom(s) only: Compounds containing an unfused pyrazole ring (whether or not hydrogenated) in the structure: Other: Aromatic or modified aromatic: Other: Other: Products described in additional U.S. note 3 to section VI.” The rate of duty will be 6.5 percent ad valorem.
